Terms & Conditions
1. About Innovative Automation Store
Innovative Automation Store is operated by Innovative Automation Pty Ltd (“Innovative Automation”, “we”, “us” or “our”).
We supply home automation products, electrical and electronic devices, smart home systems, software solutions, design services and related technical support to installers, businesses and end users.
By accessing our website, creating an account, purchasing a product or service, or subscribing to one of our services, you agree to these Terms & Conditions.
2. Products and Services
We aim to provide accurate descriptions, images, specifications and technical information for all products and services.
Product appearance, firmware, software features, packaging and specifications may occasionally change due to manufacturer updates or product revisions.
Images are provided for reference and may not always represent minor variations in colour, finish or product revision.
3. Product Compatibility
Home automation products may require specific controllers, gateways, power supplies, communication protocols, software, licences or third-party equipment.
It is the customer's responsibility to confirm compatibility before purchasing unless Innovative Automation has specifically designed or recommended the product for the customer's disclosed application.
Customers are encouraged to contact us before ordering if they are uncertain about compatibility.
Products using technologies such as KNX, Zigbee, Wi-Fi, DALI, Modbus, intercom systems or other automation protocols may require professional configuration or commissioning.
4. Installation
Some products sold through our store must be installed by a suitably qualified or licensed professional.
Electrical products requiring connection to mains voltage must be installed in accordance with applicable Australian electrical regulations and standards.
Incorrect installation, programming, configuration or use may cause the product or system to operate incorrectly.
Where installation is not included in the purchase price, installation must be arranged separately.
Nothing in this section limits any rights available under the Australian Consumer Law.
5. Pricing and GST
Unless otherwise stated, prices displayed on our Australian store are in Australian dollars.
Prices may include or exclude GST depending on how they are displayed on the relevant product or checkout page. The applicable GST amount will be shown before completing the purchase where required.
We reserve the right to correct genuine pricing, description or system errors. If an error affects an order already placed, we will contact the customer before proceeding.
6. Orders
Submitting an order does not necessarily mean that the order has been accepted.
An order is considered accepted once payment has been successfully processed and we confirm the order.
We may contact a customer if additional information is required regarding compatibility, configuration, delivery or product availability.
If we cannot supply an ordered product, we will contact the customer and provide an appropriate alternative, store credit or refund where applicable.
7. Payment
Payment must be made using one of the payment methods available at checkout.
Orders may not be processed or dispatched until cleared payment has been received.
For custom projects, design services, installation work or special-order products, separate payment conditions may apply and will be provided in the relevant quotation or proposal.
8. Delivery
Delivery times shown on our website are estimates only unless expressly guaranteed.
Delivery times may be affected by stock availability, suppliers, couriers, public holidays, weather, customs or other circumstances outside our reasonable control.
Customers are responsible for providing an accurate delivery address.
Any damaged or missing delivery should be reported to us as soon as reasonably possible so that we can investigate the matter with the courier or supplier.
9. Special Orders and Custom Products
Some automation products may be specifically ordered, programmed, configured, manufactured or customised for the customer.
Where permitted by law, change-of-mind cancellations may not be available once a special order or customisation process has commenced.
This does not affect the customer's rights where a product or service does not comply with the Australian Consumer Law.
10. Change-of-Mind Returns
We are not required to provide a refund or exchange where a customer simply changes their mind, orders the wrong item or no longer requires the product.
Where we voluntarily accept a change-of-mind return, the product must generally be unused, complete, undamaged and returned in its original packaging.
Any applicable conditions, restocking charges or return shipping costs will be communicated before the return is approved.
This policy operates in addition to, and does not replace, rights under the Australian Consumer Law. The ACCC confirms that businesses do not have to provide a remedy simply because a customer changes their mind, unless the business has adopted its own change-of-mind policy.
11. Faulty Products and Australian Consumer Law
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law. Consumer guarantees apply automatically and cannot be removed by store policies, warranties or Terms & Conditions.
Where a product or service fails to meet an applicable consumer guarantee, the customer may be entitled to a repair, replacement, refund, cancellation or compensation depending on the circumstances and whether the failure is major or minor.
We may inspect or test a product before determining the appropriate remedy.
Customers should contact Innovative Automation Store in the first instance regarding products purchased from us.
12. Manufacturer Warranties
Some products include a manufacturer's warranty.
Manufacturer warranties are provided in addition to any rights available under the Australian Consumer Law and do not replace or restrict those rights.
Warranty periods and conditions vary between manufacturers and products.
Damage caused by misuse, unauthorised modification, incorrect installation, incorrect voltage, environmental damage or operation outside manufacturer specifications may not be covered by a manufacturer's voluntary warranty, subject always to applicable consumer rights.
13. Software, Apps and Cloud Services
Some products depend on third-party software, mobile applications, cloud platforms or online services.
Features and functionality provided by third parties may change following firmware updates, software updates or changes made by the relevant manufacturer or service provider.
Where third-party services are required, customers may also be subject to that provider's own terms, privacy policies and subscription requirements.
Innovative Automation is not responsible for the ongoing availability of third-party services outside our reasonable control, except where responsibility cannot legally be excluded.
14. Software Subscriptions
Where a software product or service is supplied through a recurring subscription, the subscription conditions, price, billing frequency and cancellation arrangements will be displayed before purchase.
Unless otherwise specified, subscriptions continue until cancelled.
Customers can cancel future subscription renewals in accordance with the cancellation process shown on the relevant subscription account or product page.
Cancellation does not normally provide a retrospective refund for a subscription period already supplied, except where required by law.
15. Technical Support
Where technical support is included with a product, support is limited to the scope described on the relevant product or service page.
Complex programming, system design, remote configuration, commissioning, troubleshooting of third-party equipment or site attendance may require additional paid services.
We will advise the customer where a request falls outside the support included with the original purchase.
16. Home Automation Design and Programming
Automation system designs, drawings, programming configurations, floor plans, templates, software configurations and project documentation supplied by Innovative Automation remain subject to any applicable intellectual property rights.
Customers may use documentation supplied to them for the intended project but must not reproduce, redistribute or commercially resell proprietary materials without permission.
17. Third-Party Products and Integrations
Smart home systems often integrate products supplied by multiple manufacturers.
Compatibility can sometimes be affected by firmware updates, communication protocols, manufacturer restrictions or changes to third-party APIs and cloud platforms.
Where we state that products can integrate with another system, that statement is based on the available technical information and supported configuration at the relevant time.
18. Website Accounts
Customers are responsible for maintaining the security of their account details and passwords.
Customers must provide accurate information when creating an account or placing an order.
We may suspend or terminate an account where we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.
19. Intellectual Property
The content of this website, including graphics, product presentation, original images, software tools, designs, written material and Innovative Automation branding, may be protected by intellectual property rights.
Content belonging to third-party manufacturers remains the property of the respective rights holders.
Content may not be reproduced or commercially distributed without appropriate permission.
20. Limitation of Liability
To the maximum extent permitted by law, Innovative Automation is not liable for indirect or consequential loss resulting from circumstances outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot legally be excluded under Australian law.
That last sentence is important because contract terms cannot take away statutory consumer rights.
21. Privacy
Personal information collected through our website is handled in accordance with our Privacy Policy.
Customers should review our Privacy Policy for information regarding how personal information is collected, stored, used and disclosed.
22. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our products, services, business practices or legal requirements.
The version applying to an order will generally be the version published at the time the order was placed.
23. Governing Law
These Terms & Conditions are governed by the laws applicable in Victoria, Australia, and applicable Commonwealth legislation.
Nothing in these Terms limits any statutory rights a customer may have in another Australian jurisdiction.
